Acushnet files patent suit against a host of small ball manufacturers

If one company is planning on ignoring it, that can't be good. Doesn't that give titleist an automatic win? I'm definitely not a lawyer and have an elementary understanding of the law at best. Anyone know what company that is?

 

I imagine this is a nightmare scenario for most of these companies. Small guys like this probably aren't anticipating legal action and the fact that titleist wants a jury trial is even worse. So many lawsuits are settled out of court these days that you need legal assistance that has experience in jury trials or your legal team will get decimated.

 

This does kind of show the wizard behind the curtain for a lot of these ball companies. All made in the same place by the same guy. None of these specific companies did very well in the ball test (snell and Nicklaus ftw). Pretty much guarantees I'll never buy any of these balls.

 

Also, kickx seems like a company that stands for everything mgs dislikes about golf. Bold claims with no desire to see them validated. That's always a sign of authenticity.

 

Btw why do I think it will be a slap on the wrist? it is a patent that Titleist no longer uses on current product and has not been used for quite sometime.

 

Quite different from "seamless", which was still being used by Bridgestone when Titleist used it. Different from "mutli-layer", which Callaway (TopFlite) was still using when they filed suit.

 

The non-use implies a certain amount of "we've now use better tech". Not really a good legal stance but it should mitigate the consequences for the ones being sued..

Titleist has more than a few lawyers working for them. I'm sure they wouldn't do this unless they thought they would win. Besides, if someone infringes on a patent and you don't enforce the patent, you can lose it. So there's that.

Even if they don't win, they go to a jury trial, they're going to decimate a few of these companies portfolios.
